Ajikumar @ Aji & Ors vs State of Kerala

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Five accused were convicted of murdering two persons and assaulting another during an unlawful assembly that occurred on 22 July 1992. The Supreme Court set aside their murder convictions, finding that although medical evidence showed brutal injuries and the accused were present at the scene, the sole eyewitness account was uncorroborated and contradicted by other witnesses. The Court held that suspicion, however grave, cannot replace legal proof, and the prosecution failed to provide reliable evidence of the accused's individual participation in the murders. The Court upheld their conviction for assault but set them free, having already spent approximately 11 years in custody."
