ALD Automotive Pvt. Ltd vs Commercial Tax Officer Now Upgraded as the Assistant Commissioner (CT) & Ors

Bench: 2 — Ashok Bhushan

In Brief

The Supreme Court upheld the constitutional validity of Section 19(11) of the Tamil Nadu Value Added Tax Act, 2006, which prescribes a mandatory time limit for claiming input tax credit (before the end of the financial year or within 90 days from purchase, whichever is later). The Court rejected challenges that the provision violated Articles 14 and 19(1)(g) of the Constitution or was inconsistent with Section 3(3) of the Act. The Court held that input tax credit is a concession granted by statute, admissible only on conditions prescribed in the Act. The time period is mandatory, not directory, and cannot be extended by assessing authorities. All appeals were dismissed, upholding the High Court's judgment.
