Amar Nath Chaubey's father was shot dead in December 2015. The police initially investigated the murder and charged some accused, but filed a closure report against Respondent No. 5, who was suspected of conspiracy, claiming insufficient evidence because the informant had not provided materials. The Supreme Court held that this closure report was casual and perfunctory. The Court ruled that fair investigation is constitutionally mandated under Articles 14 and 21, and though police investigation is exclusive, courts must intervene if investigation is improper or in bad faith. The Court set aside the closure report and directed fresh investigation by a senior police officer within two months.
