Amrita Singh vs Ratan Singh and another

Bench: 2 — A.K. Sikri

In Brief

A woman left her matrimonial home in 2008, alleging cruelty and dowry demands by her husband, a railway employee. She claimed maintenance under Section 125 Cr.P.C. for herself and her child. The trial court granted Rs. 4,000 each for her and her son. The High Court quashed this, stating she had no reasonable cause to leave. On appeal, the Supreme Court allowed the appeal, holding that the Family Court had found the husband guilty of cruelty and dowry demands, and the woman had been convicted in a Section 498A IPC case. These findings established reasonable cause for leaving, and the High Court's cryptic order contradicting judicial findings could not stand.
