A wife sought to transfer matrimonial proceedings for restitution of conjugal rights from a court in Gujarat to Mumbai, citing changed circumstances following her mother's death and hardship in attending frequent hearings. The Supreme Court held that while a dismissed transfer petition does not bar a fresh petition based on new circumstances, transfer at the advanced stage of proceedings would derail justice. Instead of transferring, the Court permitted the wife to reopen her evidence, allowed her virtual appearance except during cross-examination, and directed the husband to bear her travel expenses (₹10,000 per visit), enabling her fair participation without relocating the case."
