Anapurna Jaiswal applied for an Indian Oil Corporation dealership in 2011 and initially ranked first based on her lease of the proposed site. The corporation later rejected her on grounds that her lease deed, though dated 08.11.2011, was contractually made operative only from approval of the outlet—meaning she lacked a valid lease on her 11.11.2011 application date. She sought 35 marks for possessing a long-term lease, which qualified only those with leases already in effect on the application date. The Supreme Court held that Section 47 of the Registration Act does not backdate lease commencement; her lease remained contingent on future approval and never vested as on the application date. Thus, she was ineligible for those marks. Her appeal was dismissed.
