M Lalitha challenged the National Company Law Tribunal's approval of a resolution plan submitted by Angelwoods Association. She filed her appeal on the last day of the 45-day deadline but without a mandatory certified copy of the order being appealed. She did not apply for this certified copy until months later, after the deadline had passed, and never sought exemption from this requirement. The National Company Law Appellate Tribunal condoned the delays and allowed the appeal to proceed. The Supreme Court set aside this decision, holding that an appeal under the Insolvency and Bankruptcy Code must be accompanied by a certified copy or at minimum filed with an application for one before the deadline expires. The Court ruled the appeal was wholly incompetent and should have been rejected outright.
