Anglo American Metallurgical Coal sought to set aside an arbitral award where the majority of arbitrators concluded a breach of a Long-Term Agreement by the respondent for failure to supply coal. The Court held that while the award might be questioned as to its plausibility, an arbitral award can only be set aside on very narrow grounds: if it is perverse (not a possible view), based on no evidence, contrary to fundamental policy, or patently illegal. The Court found the majority award was a possible view supported by the totality of correspondence between the parties. No grounds for judicial intervention were established. The appeal was allowed.
