Supreme Court of India 2016-02-25 dismissed

Anil @ Bawa & Ors vs State of Haryana & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Supreme Court upheld the conviction of three accused for murdering Partap. The deceased was beaten to death by the accused following an allegation that he had attempted to outrage the modesty of a family member. The Court relied on the eyewitness testimony of the deceased's father (Anand Singh), corroborated by medical evidence of injuries consistent with sharp weapons and Lathis. The Court rejected arguments that the non-examination of two FIR witnesses warranted adverse inference, finding the father's account inherently credible and reliable. The Court held the accused had no right to take the law into their own hands. Both courts below had properly appreciated the evidence. The appeals were dismissed.
