Anil & Ors vs New India Assurance Co. Ltd. & Ors

Bench: 3 — D.Y. Chandrachud

In Brief

A deceased person (Ram Kanwar) was allegedly run over by a tractor on 12 January 1995. The Motor Accident Claims Tribunal awarded his family ₹21.38 lakh compensation. However, the High Court reversed this, finding the claimants had fabricated the entire case. The Supreme Court upheld the reversal, noting multiple red flags: no post-mortem was conducted; the complaint was filed a month late despite eyewitnesses; no hospital records showed fatal injuries; and the driver gave inconsistent statements. The Court held these factors collectively proved the claim was fraudulent, designed to obtain unlawful compensation using the insured vehicle as a pretext.
