A textile company sued for recovery of over Rs. 1 crore. The defendants sought leave to defend and were ordered to deposit 50% of the claim. They challenged this unsuccessfully before the High Court and Supreme Court. The plaintiff then moved to decree the suit, which the Trial Court initially rejected. The High Court allowed the plaintiff's challenge and directed the Trial Court to accept and decree the suit. By the time the appellants challenged this order, the suit had already been decided by final decree. The Supreme Court dismissed the appeal as infructuous, noting that an appeal challenging an intermediate procedural order becomes moot when the underlying suit has been finally resolved.
