Forty-four consumers purchased office spaces in a real-estate project under agreements requiring possession within four years. The developer failed to deliver. The consumers filed a representative application under Section 12(1)(c) of the Consumer Protection Act before the National Commission. The Commission dismissed it, holding that complaints on behalf of some consumers are not maintainable. The Supreme Court set aside the dismissal, holding that such collective applications are maintainable to facilitate resolution of disputes affecting large numbers of consumers with common interests. The appeal was allowed and the matter remanded to the National Commission.
