A labourer suffered 60% permanent disability and loss of his right hand in a motor vehicle accident caused by the negligent driving of a truck driver. The lower courts awarded compensation for loss of income and suffering but failed to award anything for loss of future prospects. The Supreme Court held that permanent disability necessarily affects future earning prospects and allowed the appeal, awarding an additional Rs. 1,50,000/- for loss of future prospects, enhancing total compensation to Rs. 5,03,200/- plus 9% interest, exercising its constitutional power to award compensation legitimately due under law.
