Supreme Court of India 2021-02-18 dismissed

Anmol Kumar Tiwari & Ors vs State of Jharkhand & Ors

Bench: 2 — L. Nageswara Rao

In Brief

The Supreme Court upheld the High Court's decision to reinstate 42 police officers whose appointments had been cancelled due to irregularities in the initial selection process for 384 Sub-Inspector positions advertised in 2008. Although the officers benefited from a flawed selection process, the Court found them not personally culpable and entitled to relief because they had completed training and served the State for considerable periods. The Court rejected claims by higher-scoring candidates who failed selection, holding they were not similarly situated to the reinstated officers and had no right to appointment against the original 384 advertised vacancies. The appeals were dismissed."
