Ansal Crown Heights Flat Buyers Association (Regd.) vs M/s. Ansal Crown Infrabuild Pvt. Ltd. & Ors

Bench: 2 — Dipankar Datta, Augustine George Masih

In Brief

Flat buyers pursued consumer complaints against Ansal Crown Infrabuild Pvt. Ltd. (ACIPL) for delayed possession of apartments, obtaining awards for delivery or refund of deposits with interest. When ACIPL failed to comply and entered insolvency proceedings, buyers sought to execute the awards against ACIPL's directors and promoters. The Supreme Court held that execution of a decree cannot extend to persons not named as parties to the original complaint and against whom no liability was adjudicated. Directors and promoters cannot be held personally liable without prior notice, pleadings, and findings establishing their individual culpability. The Court dismissed the appeals, holding that liability under a decree binds only the adjudicated parties.
