Anuj Joshi & Anr vs Chief Conservator of Forests & Ors

Bench: 2 — Uday Umesh Lalit

In Brief

This contempt petition challenged alleged violations of the Supreme Court's August 2013 judgment directing the government to withhold environmental and forest clearances for hydroelectric projects in Uttarakhand following devastating floods. The petitioner claimed the State had granted forest clearance for the Vishnugad-Pipalkoti Project after the judgment. The Court found no violation: the forest land approval was actually issued in May 2013, before the judgment. The December 2013 letter merely communicated this pre-existing decision. The Court dismissed the petition, finding the petitioner had made false and misleading statements constituting abuse of process.
