A defendant appealed a High Court order that allowed the plaintiff's second appeal in a land dispute case and restored a trial court's decree granting the plaintiff an injunction. The Supreme Court held that the High Court cannot lawfully admit and hear a second appeal without first formulating a substantial question of law, as required by Section 100 of the Code of Civil Procedure. The High Court's failure to frame such a question rendered its order legally unsustainable. The Court set aside the High Court's judgment and remanded the case for fresh decision in accordance with law.
