Arjun and Anr. etc. etc vs State of Chhattisgarh

Bench: 2 — R. Banumathi

In Brief

Three men (Arjun, Lalaram, and Padumlal) were convicted of murder under Section 302 IPC and sentenced to life imprisonment by a trial court in Chhattisgarh. The incident arose from a dispute over tree-cutting on land. The Supreme Court examined whether the conviction was sustainable, particularly addressing challenges regarding witness credibility and Arjun's presence at the scene. The Court held that the evidence established a sudden fight with no premeditation and no undue advantage or cruelty by the appellants. Therefore, exception (4) to Section 300 IPC applied. The conviction was modified from murder (Section 302) to culpable homicide not amounting to murder (Section 304 Part I IPC), and the sentence was reduced to time already served. The appeals were partly allowed.
