Supreme Court of India 2018-02-02 remanded

Arun Maan & Ors vs State of Uttar Pradesh & Ors

Bench: 2 — Kurian

In Brief

The appellants filed writ petitions challenging a decision that 81 transport licenses were fake. The Delhi High Court dismissed their earlier petitions as withdrawn but granted liberty to later challenge the underlying orders. Within five months, they filed fresh petitions before the Allahabad High Court, which dismissed them for laches citing a five-year delay. The Supreme Court held this was erroneous: the liberty granted by Delhi High Court reset the clock, and filing within five months did not constitute unreasonable delay. The matter was remitted for fresh consideration on merits.
