Supreme Court of India 2017-05-04 dismissed

Arun S/o Shankar Dokhe & Another vs State of Maharashtra & Others

Bench: 2 — A.M. Khanwilkar

In Brief

Petitioners challenged the rejection of their objection to the reservation category assigned to an Electoral Division (Chande-Kasare) in panchayat elections, alleging violation of rotation rules for women's reserved seats. The High Court dismissed their writ petition on the ground of a constitutional bar due to the election schedule declaration. The Supreme Court granted interim relief suspending elections in that division but ultimately dismissed the petition. Although the Court acknowledged the complexity of the reservation rotation scheme and potential violations, it held that interfering at this advanced stage—after Phase One elections had concluded elsewhere—would upset the constitutional ratio of reservations across other constituencies, violating statutory law. The Court left all substantive questions open and permitted pursuit of other available remedies.
