The Court dismissed an appeal concerning a property dispute after a lease expired. The appellants claimed they were entitled to compensation for improvements made to the land under the Kerala Compensation for Tenants Improvements Act 1958, and sought to remain in possession until this compensation was adjudicated and paid. The respondents (decree holders) invoked the doctrine of constructive res judicata, arguing the compensation claim should have been raised in earlier execution proceedings. The Court held that the appellants, though strangers to the original decree, had an opportunity and obligation to raise all claims regarding their right to the property during execution proceedings under Order XXI Rules 97–103 of the CPC, which constitute a complete code. By failing to assert their compensation claim at that stage, it was barred under Explanation IV of Section 11 of the CPC, which deems matters that 'might and ought' to have been raised in earlier proceedings as directly in issue. The appeal was dismissed.
