A public charitable hospital trust in Tamil Nadu was challenged by two of its trustees through a suit seeking to frame a proper scheme of administration and remove certain family members as trustees. The High Court dismissed the suit as being for private rights under Section 92 of the Civil Procedure Code. The Supreme Court held that Section 92 requires three conditions: the trust must be for public charitable purposes; there must be breach of trust or need for court direction; and relief must be within Section 92. The Court found all three satisfied here. Although one of the proposed new trustees was a plaintiff, the suit's substance was protecting the trust's public purpose—operating a hospital—not vindicating personal rights. The Court reinstated the trial court's grant of leave and allowed the appeal, holding that a suit need not fail merely because an incidental party benefit exists if the primary purpose is proper public trust administration.
