Ashutosh Agnihotri vs High Court of Madhya Pradesh and anr

Bench: 2 — Madan B. Lokur

In Brief

Ashutosh Agnihotri applied for a public examination but his application, sent by speed post on 10 January 2017, was received by the High Court on 21 January 2017—one day after the deadline. The High Court rejected it. The Supreme Court, on reviewing the sealed examination result, found Agnihotri had qualified. The Court held that the applicant could not be blamed for a one-day postal delay beyond his control and that procedural rejection should not bar him from interview consideration. The Court set aside the rejection order and directed his consideration for interview. A companion petition by another candidate who failed the examination was dismissed.
