Avni Prakash, a student with dysgraphia (a specified learning disability), was denied compensatory time during her NEET examination despite being entitled to it under disability guidelines. The Supreme Court held that persons with specified disabilities are entitled to reasonable accommodation and inclusive education rights under the RPwD Act 2016, regardless of whether they meet the higher threshold of "benchmark disability." The Court found the National Testing Agency negligent in enforcing statutory entitlements and ruled that it must take corrective measures to remedy the injustice. While directing no fresh examination (which would disrupt admissions), the Court ordered the Agency to consider remedial options like mark extrapolation and mandated future clarity in examination bulletins and staff training on disability accommodations.
