Avtar Singh & Anr vs State of Punjab Collector & Anr

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Land owners challenged the High Court's award of compensation for 67 acres acquired in villages Alladad Chak and Machhi Joan for housing purposes. The High Court had fixed ₹8,20,000 per acre for Alladad Chak and ₹6,26,000 per acre for Machhi Joan. The Supreme Court held that since the land was acquired in a single block for identical purpose and the two villages were adjacent with similar potentiality, identical compensation should apply to both. Using comparable sale evidence dated September 1997 adjusted for 20% development deduction and 15% price escalation over three years, the Court awarded ₹9,72,000 per acre with statutory benefits to both villages, finding no justification for differential valuation."
