A tenant sought a declaration of tenancy rights and permanent injunction against interference with possession of a property. The Trial Court maintained status quo, and the High Court appointed a special officer to preserve the property. The defendant appealed, and the Supreme Court held that prima facie findings made during interlocutory injunction proceedings do not bind or influence the Trial Court's final decision on the merits of the suit. The Court directed the Trial Court to proceed to trial uninfluenced by earlier observations, within one year, and maintained the interim preservation order until final judgment. The civil suit would be decided solely on the basis of pleadings and evidence adduced at trial."
