B.V. Ram Kumar, a medical institute director, was charged under Sections 269, 270, and 504 of the Indian Penal Code after allegedly scolding an assistant professor over her work performance during COVID-19. The High Court dismissed his plea to quash proceedings. The Supreme Court allowed his appeal, holding that a superior officer's workplace admonition regarding discipline and duty performance cannot constitute an "intentional insult" under Section 504, IPC. The Court applied the test of a reasonable person and found that absent mens rea to provoke breach of peace, and given the legitimate authority to maintain workplace discipline, the chargesheet lacked necessary ingredients. All criminal proceedings were quashed.
