Baljit Kaur vs State of Punjab and Anr

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Three persons were convicted of murdering Santokh Singh under Section 302 IPC despite being acquitted of conspiracy and unlawful assembly charges. Only one co-accused, Amandeep Singh, inflicted the fatal sword injury. The Supreme Court held that persons who inflicted no injury on the deceased cannot be convicted under Section 302 IPC alone when acquitted of Section 120B and 149 charges. Appeals of Baljit Kaur and Gurpratap Singh were allowed and their convictions set aside. Amandeep Singh's appeal, as the actual perpetrator, was dismissed.
