The Supreme Court held that while territorial jurisdiction objections can be raised, the tribunal's decision to allow evidence before rejecting jurisdiction created illegality: it decided all substantive issues against the claimant without examining them on merit. The benevolent Motor Vehicles Act requires remand to the tribunal to adjudicate on merits, as the insurance company had an office within the tribunal's jurisdiction, no prejudice occurred, and the claimant suffered prolonged failure of justice.
