A father sought compensation for the death of his son in a motorcycle accident caused by a negligently driven tractor. The Claims Tribunal dismissed the claim on lack of territorial jurisdiction without deciding merits, and the High Court upheld this dismissal. The Supreme Court held that while territorial jurisdiction objections can be raised, the tribunal's decision to allow evidence before rejecting jurisdiction created illegality: it decided all substantive issues against the claimant without examining them on merit. The benevolent Motor Vehicles Act requires remand to the tribunal to adjudicate on merits, as the insurance company had an office within the tribunal's jurisdiction, no prejudice occurred, and the claimant suffered prolonged failure of justice.
