BGS SGS Soma JV filed three civil appeals challenging High Court orders that admitted Section 34 petitions (applications to set aside arbitral awards) under the Arbitration Act. The Supreme Court held that once parties choose the seat of arbitration, courts at that seat gain exclusive jurisdiction over arbitral proceedings. The High Court lacked jurisdiction to entertain petitions filed elsewhere. The Court set aside the impugned judgments and directed the petitions to be presented in the appropriate courts at the chosen seat, reaffirming that the seat of arbitration determines exclusive judicial jurisdiction."
