Bikash Manna sought anticipatory bail under Section 438(2) of the Criminal Procedure Code in connection with an FIR registered at Police Station Domjur, Howrah. The High Court had denied protection. The Supreme Court granted the appeal, allowing anticipatory bail on the ground that the de-facto complainant consented to withdrawal of deposited amounts and had no interest in prosecution. The Court directed the appellant to execute a bond of Rs. 25,000 with two sureties of the like amount and to cooperate with the investigation. The Investigating Officer was empowered to release the appellant on bail upon satisfaction of these conditions.
