This case concerns the scope of appellate review in civil proceedings. The appellant sued for arrears of rent and eviction from a shop. The trial court found the appellant had proved the landlord-tenant relationship but held the tenant was not in default. The appellant appealed without challenging the landlord-tenant finding (which favoured him), and the defendants filed no cross-objection. The Supreme Court held the First Appellate Court lacked jurisdiction to re-examine the landlord-tenant finding and erred by doing so. The High Court similarly erred in affirming this error. The case was remanded for proper appellate review limited to issues decided against the appellant.
