A widow sought restoration of her late husband's vehicle, which had been seized as case property in a murder investigation. The Judicial Magistrate initially allowed the deceased's brother-in-law temporary custody, but when the widow withdrew her consent and requested custody for herself, the Magistrate ordered the vehicle returned to her. The High Court dismissed the brother-in-law's revision petition. The Supreme Court held that the widow, as the deceased's spouse, had the superior claim to the vehicle's custody, and the Magistrate's decision was justified. The Court dismissed the appeal and ordered restoration of the vehicle to the widow, directing refund of the deposit the appellant had made.
