Campaign for Judicial Accountability and Reforms vs Union of India and Another

Bench: CB — A.K. Sikri, Ashok Bhushan

In Brief

The Supreme Court clarified that the Chief Justice of India, like the Chief Justice of a High Court, is the master of the roster and has sole authority to constitute Benches and allocate cases. No Bench can direct the Chief Justice regarding Bench composition or allocate matters to itself. The Court held that the principles in State of Rajasthan v. Prakash Chand apply to the Supreme Court to ensure orderly justice administration. Orders violating these principles are ineffective in law. The petition was remitted for proper allocation and listing before an appropriate Bench by the Chief Justice.
