In this interlocutory application arising from a 2G Spectrum corruption case, the Supreme Court addressed the challenge of serving summons on non-resident accused in foreign jurisdictions. Unable to effect service on four accused persons (including Ananda Krishna Tatparanandam and Maxis Communications entities) despite mutual assistance procedures, the Court exercised its inherent powers to restrain revenue earned through disputed 2G Spectrum licences originally granted to Aircel Telecommunications. To protect innocent spectrum subscribers from harm, the Court directed the Ministry to arrange provisional transfer of subscribers to another service provider. The Court also stayed all selling and trading of the spectrum and directed publication of the order in Malaysian newspapers to notify the accused.
