A Tuticorin Port Trust employee, appointed as a Pilot Officer in 2008 with a Certificate of Competency from Singapore's Maritime Authority, was terminated in 2012 on the ground that his certificate was not recognized by the Government of India. The High Court set aside the termination and ordered reinstatement with full back wages. The Supreme Court affirmed the reinstatement but reduced back wages to 40% in view of the peculiar circumstances, holding that the Singapore certificate was acceptable as it was from a white-list IMO country and no objection had been raised at appointment. The appeal was partly allowed."
