Supreme Court of India 2019-07-16 dismissed

Chaman Lal (D) Thr. Lrs vs Kamlawati (D) Thr. Lrs

Bench: 2 — Sanjay Kishan Kaul

In Brief

A dispute arose over whether a 1958 gift deed transferred half or the entire land to the donee. The trial and first appellate courts found only half was gifted; the High Court, after directing a fresh translation of the original Urdu-Persian document, concluded the entire land was gifted. The Supreme Court upheld the High Court's decision, holding that the High Court did not exceed jurisdiction under the Punjab Court Act. Since the gift deed—a document of title—was the crux, correct translation was essential. The Court found the deed unambiguously transferred the whole property, supported by undisputed possession remaining with the donee and complete registration in her name.
