& ORS. & ETC. ETC vs MANJIT KUMAR GULATI

Bench: 2 — Bela M. Trivedi, Satish Chandra Sharma

In Brief

The Supreme Court set aside a High Court order that had allowed writ petitions filed by default-paying allottees and their alleged tenant seeking restoration of a leasehold plot in Chandigarh. The allottees had failed to pay 75% of the auction price and the lease was validly cancelled after multiple opportunities and a show cause notice. The alleged tenant (M/s. Mohit Medicos) had no documentary evidence of tenancy and was deemed a proxy litigant. The Court held the High Court erred in interfering with the statutory authority's decision and allowed the appeals, setting aside the restoration order.
