The Supreme Court reversed this, holding that a Hot Mix Plant was not listed as a mandatory pre-qualification requirement under the tender document, appearing only in the list of approved makes for contract execution. Therefore, L-2's qualification was proper, the financial bids were correctly opened, and the contract award to L-1 was valid.
