Chhipa Faridmahmed Suleman vs Chhipa M. Suleman Khedawala & Ors

Bench: 2 — Kurian

In Brief

Two aged brothers (83 and 87 years old) who had been disputing over partition of property and a gift deed since 1987 sought an amicable resolution. The Supreme Court, moved by their advanced age and desire to bring family peace, facilitated a settlement whereby Respondent No. 1 would pay the appellant Rs. 36 lakhs within 12 months, and the appellant would surrender vacant possession of the disputed property within 24 hours of payment. The Court held that upon performance of these conditions, all disputes regarding partition and gift deed would stand concluded with no further litigation permitted between the parties.
