Commissioner of Central Excise and Service Tax, Raipur vs Singh Transporters

Bench: 2 — Ranjan Gogoi

In Brief

Singh Transporters transported coal from pit-heads to railway sidings within mining areas. The revenue authority sought to classify this as a mining-related service under Section 65(105)(zzzy) of the Service Tax Act, 1994, making it taxable. The Supreme Court held that the service should instead be classified under Section 65(105)(zzp) as 'transport of goods by road,' which is the appropriate tax classification. The Court reasoned that the nature of the activity—transporting goods—determines the classification, not the geographical location where it occurs, even within mining areas.
