Supreme Court of India 2016-03-30 remanded

Commissioner of Central Excise, Indore vs Grasim Industries Ltd

Bench: 3 — <UNKNOWN>

In Brief

Grasim Industries, a manufacturer of industrial gases supplied in various containers, challenged central excise assessments that included container-supply charges in the taxable value. The Supreme Court had to resolve whether such ancillary charges fell within the definition of 'transaction value' under Section 4 of the Central Excise Act, 1944 (as amended in 2000), or were excluded by the charging framework in Section 3. Finding that two earlier Three-Judge Benches had reached apparently conflicting views on how Sections 3 and 4 interrelate, the Court declined to decide the merits and referred the matter to a Larger Bench for authoritative resolution.
