Commissioner of Customs (I) vs Aasu Exim Pvt. Ltd

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

This Customs Act appeal challenges the Appellate Tribunal's reversal of an order holding the respondent liable for differential duty of Rs 4.79 crore. The dispute concerned whether imported yarn was correctly graded (respondent claimed grades A, B, C; Revenue claimed only A and AA) and whether the correct transaction value was used. The Tribunal found the respondent's grades justified by manufacturer documentation and a Taiwan Board of Foreign Trade letter confirming such grades exist. The Tribunal also found most of Revenue's comparative bills of entry unreliable. The Supreme Court held no substantial question of law warranting appellate review arose, as the Tribunal's conclusion was a permissible one on the material evidence. Appeal dismissed.
