In Brief
The Supreme Court upheld the Income Tax Appellate Tribunal's decision that local Public Works Department (PWD) rates, not Central PWD rates, should be used to determine construction costs for income tax valuation purposes. While the Court found that the reference to a Departmental Valuation Officer under Section 142A was technically valid (as the assessment was not final while a Revenue appeal was pending before the High Court), it found no merit in interfering with the Tribunal's established ruling on the use of local PWD rates. The appeal was dismissed without costs.
