Common Cause : A Registered Society vs Union of India

Bench: 2 — Ranjan Gogoi

In Brief

The Court upheld the Lokpal and Lokayuktas Act, 2013 as workable and enforceable despite the absence of a recognized Leader of Opposition in Parliament. Petitioners sought to block Lokpal appointment proceedings, arguing the Act could not function without amendments then pending in Parliament. The Court held that Section 4(2) of the Act explicitly permits a truncated Selection Committee (without a Leader of Opposition) to appoint the Lokpal. Proposed amendments aim at more efficient operation, not cure of legal defects. The Court declined to read down the statute or stay its enforcement, affirming that duly enacted and notified laws must be given effect to, regardless of pending amendments.
