Commr. of Cus. (Sea Port-Import), Chennai vs Indo Deutsche Trade Links

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Commissioner of Customs challenged a tribunal decision that allowed goods imported as 'Used Rails' to be classified as 'Heavy Melting Scrap' under a beneficial customs notification. The Supreme Court found the tribunal's classification erroneous. The importer's own letter admitting misdeclaration and requesting forgiveness conclusively established that the goods were actually rails, not scrap. The Court restored the original customs order classifying the goods correctly as rails under the higher tariff rate and upheld the imposed duty, fine, and penalty. The appeal was allowed.
