A Goan agricultural community (Communidade) sought permission to compromise a tenancy dispute by bifurcating disputed land 60% to the private respondents and 40% to itself. The Administrative Tribunal and High Court refused permission. The Supreme Court upheld the refusal, holding that Article 30(4)(g) of the Code of Comunidades does not confer unfettered compromise power without Tribunal sanction. The proposed compromise violated the Tenancy Act and Land Use Regulation Act by creating freehold ownership and allowing non-agricultural use of agricultural land without following statutory procedures. The Court dismissed the appeal, holding that compromise cannot circumvent or defeat express statutory provisions, and constitutes an abuse of legal process.
