D.M., Oriental Insurance Co. Ltd vs Swapna Nayak & Ors

Bench: 2 — Abhay Manohar Sapre

In Brief

A truck driver caused an accident on NH 5 that killed a U.S.-based resident working in California and his mother. The Motor Accidents Claim Tribunal awarded Rs.4,36,95,740/- compensation to the deceased's heirs. The High Court reduced this to Rs.3,75,00,000/- by deducting income tax from the deceased's salary. The Insurance Company sought further reduction, while claimants sought enhancement. The Supreme Court upheld the High Court's award, holding that concurrent findings on material facts should not be disturbed, and the overall compensation was just and reasonable within Section 166 of the Motor Vehicles Act despite potential imperfections in individual heads.
