The trial and lower appellate courts dismissed the suit, finding she had not proved the payment (no bank passbook, and the bank confirmed no withdrawal during the relevant period) and the agreement was for far less than the property's actual value. The High Court reversed this based only on pleadings, ignoring evidence. The Supreme Court held that concurrent findings of fact cannot be overturned without discussing evidence, and a defendant's denial is not an admission. The appeal was allowed and the trial court's judgment restored.
